These Terms of Use ("Terms") govern your access to and use of the CAPPED mobile application ("the app"), operated by CAPPED ("we", "us", "our"). By creating an account or using the app you agree to these Terms. If you do not agree, do not use the app.

1. Who Can Use CAPPED
Minimum age
You must be at least 13 years old to create an account or use the app. When you create an account, you will be asked to enter your date of birth. If you are under 13, your account will not be created and no personal information will be retained.
We do not knowingly collect personal information from anyone under 13. If you believe someone under 13 has created an account, please contact us at adamshakerwork@gmail.com and we will delete the account.
Users aged 13 to 17
If you are under 18, a parent or guardian must:
- give permission for you to use the app and agree to these Terms on your behalf before you register;
- supervise your use of the training, gym, and nutrition features; and
- understand that your personal information (name, date of birth, photos, and match footage) will be processed as described in our Privacy Policy.
By registering as a user aged 13–17, you confirm that a parent or guardian has given this permission.
Coaches and adult users
Coaches and other adult users agree to these Terms for themselves. If a coach creates content involving a player, the coach is responsible for having the right to upload that content and for complying with any applicable law, including child safety legislation.
Account security
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
2. Your Content
Ownership
You keep ownership of the match footage, clips, photos, player statistics, and other information you upload or link within the app ("Your Content").
Licence to CAPPED
By uploading or linking Your Content, you grant CAPPED a limited, non-exclusive, royalty-free licence to download footage from the URL you provide; process, edit, and render Your Content to produce highlight reels and other features; store the rendered output so you can access it within the app; and display Your Content back to you within the app. This licence exists solely to provide the app's features to you. We do not use Your Content to train AI models or for any purpose unrelated to delivering your highlight reels and app features.
Your responsibility for content
You confirm that:
- you have the right to upload Your Content, including any footage or images featuring other people (such as teammates or opponents);
- uploading Your Content does not breach anyone else's intellectual property rights, privacy rights, or any competition rules or third-party platform terms;
- if Your Content includes footage of other identifiable people, particularly minors, you have obtained appropriate consent from those people or their parents/guardians before uploading; and
- you will not upload broadcast footage, copyrighted music, or any content you do not have the right to use.
Prohibited content
Do not upload content that you do not have rights to; contains offensive, defamatory, or harmful material; violates any person's privacy; or is illegal under Australian law or the laws of any jurisdiction in which the app is used. We may remove content that breaches these requirements and may suspend or close accounts that repeatedly breach them.
3. Highlight Reels and AI Features
How the AI works
The app uses automated tools to identify action moments in footage you provide, order clips, and apply branding to produce highlight reels. Results depend on the quality and length of the footage you supply. The automated tools may not identify every relevant moment or may include moments you would prefer to exclude.
No guarantees about outcomes
CAPPED is a tool to help you present your football. It does not guarantee any outcome — including interest from clubs, scouts, or coaches; selection for trials; or any signing, contract, or professional offer. The app is a presentation tool, not a talent agency.
No guarantee of accuracy
AI-generated highlight reels reflect the footage you provide and the automated detection of that footage. We do not guarantee that reels are complete, accurate, or representative of your ability.
4. Training, Gym and Nutrition Features
The training, gym, and nutrition features provide general guidance for healthy, active people. They are subject to the Health and Training Disclaimer below, which forms part of these Terms.
In summary: this content is not medical advice, nutritional therapy, or physiotherapy. Consult a qualified healthcare professional before starting any new exercise or nutrition program, particularly if you are under 18, have an injury, a medical condition, or a dietary restriction. If you or someone you know has a history of disordered eating, do not use the nutrition features without guidance from a healthcare professional.
The full Health and Training Disclaimer is available within the app and applies to all use of these features.
5. Subscriptions and Billing
Plans and pricing
CAPPED offers a free tier and the following paid subscription plans, billed in Australian dollars (AUD):
- Unlimited: AUD 7.99/month
- Pro: AUD 12.99/month
- Elite: AUD 21.99/month
Prices and plan features are shown in the app and may change. We will provide notice of price changes before they take effect.
Apple as payment processor
Paid subscriptions are processed by Apple through the Apple App Store. Apple is the merchant of record for all App Store transactions. By subscribing you agree to Apple's Terms of Service and payment policies in addition to these Terms.
Auto-renewal
Your App Store account is charged for the renewal price within 24 hours before the end of the current period. To cancel, open Settings → [your name] → Subscriptions → CAPPED → Cancel Subscription. You must cancel at least 24 hours before the end of the current period to avoid being charged for the next period. Cancelling stops future renewals; it does not refund the remainder of your current billing period.
Trials and promotions
If we offer a free trial or introductory price, the terms of that offer will be disclosed in the app before you subscribe. Your subscription will convert to the regular paid rate at the end of any trial period unless cancelled before then.
Refunds
Refunds for App Store purchases are governed by Apple's refund policies and by applicable consumer law, including the Australian Consumer Law (ACL). To request a refund through Apple, visit reportaproblem.apple.com. You may also contact us directly at adamshakerwork@gmail.com if you wish to raise an issue under the ACL — see Section 7 for your statutory rights.
6. Acceptable Use
You must not use the app to break any law or regulation; infringe the intellectual property, privacy, or other rights of any person; upload harmful, offensive, defamatory, or unlawful content; impersonate any person or misrepresent your affiliation with any organisation; interfere with the app's operation, security, or other users' experience; or attempt to gain unauthorised access to any part of the app or our systems.
We may suspend or close accounts that breach these requirements, with or without prior notice depending on the severity of the breach.
7. Australian Consumer Law Rights
Nothing in these Terms limits or excludes any right or guarantee you have under the Australian Consumer Law (ACL, Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
Under the ACL, the app's services come with guarantees that they will be provided with due care and skill, will be fit for any particular purpose you make known to us, and will be provided within a reasonable time. If there is a major failure in the service, you are entitled to a remedy — which may include a refund — regardless of Apple's refund policies. Any limitation of liability in these Terms applies only to the maximum extent permitted by law, including the ACL.
8. Disclaimers and Limitation of Liability
"As is" service
To the maximum extent permitted by law, the app is provided "as is" and "as available." We do not warrant that the app will be uninterrupted, error-free, or that all features will be available at all times.
Limitation on indirect loss
To the maximum extent permitted by law, we are not liable for any indirect, special, incidental, or consequential loss arising from your use of the app — including loss of data, loss of profits, or loss of opportunity — even if we have been advised of the possibility of such loss.
Liability cap
Where liability cannot be excluded, our total liability to you for any claim arising from the app is limited to the greater of: (a) the total subscription fees you paid in the 12 months before the claim arose; or (b) AUD 100. These limitations do not apply to liability that cannot be excluded or capped under the ACL or any other applicable mandatory law.
9. Messages and Communications Within the App
Messages and other direct communications between users within the app are stored on your device only. CAPPED does not transmit, access, or store message content on our servers. We are not responsible for the content of user-to-user messages. You are responsible for the messages you send and for ensuring they comply with these Terms and applicable law.
Reporting and blocking
Because messages stay on your device, we cannot read them or moderate them proactively. Every conversation and player profile has a “⋯” button offering Report and Block. Reporting records the account and the reason; blocking removes that person from your messages and from Discover, and can be undone from the Messages screen.
If you are under 18 and an adult contacts you in a way that makes you uncomfortable, tell a parent, guardian or coach as well as blocking them. For anything urgent, email adamshakerwork@gmail.com. In an emergency, contact the police on 000.
10. Privacy
Our Privacy Policy explains how we collect, use, and protect your personal information. By using the app you acknowledge and agree to our Privacy Policy, which is available within the app's legal section and at the URL provided in App Store Connect. We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
11. Intellectual Property
Our content
The CAPPED name, logo, app design, and all content created by us are owned by or licensed to CAPPED and are protected by copyright and other intellectual property laws. You may not copy, reproduce, modify, or distribute our content without our prior written consent.
Feedback
If you provide feedback or suggestions about the app, you grant us a perpetual, royalty-free licence to use that feedback to improve the app without any obligation to you.
12. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date at the top. For material changes we will notify you within the app. If you continue to use the app after the updated Terms take effect, you accept the updated Terms. If you do not accept the changes, you may close your account.
13. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms or your use of the app will be subject to the exclusive jurisdiction of the courts of Queensland, Australia, except where applicable law provides otherwise.

The drills, gym plans, nutrition plans, calorie and protein targets, water targets, and related content in CAPPED are provided for general informational and educational purposes for healthy, active people.
This content is not medical advice, nutritional therapy, physiotherapy, or a substitute for guidance from a qualified doctor, dietitian, physiotherapist, or coach who knows your individual circumstances.
Consult a qualified healthcare professional before starting any new exercise or nutrition program, especially if you have an injury, a medical condition, an allergy, a dietary restriction, are pregnant, or are taking medication.
If you or someone you know has a history of disordered eating, do not use the nutrition features without guidance from a qualified healthcare professional.
Nutrition plans and calorie and protein figures are general estimates and are not tailored to your individual needs, allergies, or medical conditions. Adjust them to your own body, goals, and any professional advice you have received.
Warm up properly, use correct technique, and work within your current ability level. Stop immediately and seek medical attention if you feel pain, dizziness, chest discomfort, or any symptom that is not normal training fatigue.
Exercise carries an inherent risk of injury. You take part at your own risk.
If you are under 18, only use the training, gym, and nutrition features with the knowledge and supervision of a parent, guardian, or qualified coach.
To the maximum extent permitted by law, CAPPED is not liable for any injury, illness, loss, or damage arising from your use of the training, gym, or nutrition content. This limitation does not affect any rights you have under the Australian Consumer Law.
